By accessing or using our mobile application called Relaxito (the "App," available on the Google Play Store and the Apple App Store), our website hosted at https://www.walmin.com/relaxito (“our site”), and any other Zen Sounds products or services (collectively, the "Services"), you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please refrain from using our Services.
The App, our site, and all their original content, features, and functionality, including but not limited to all information, software, text, displays, images, audio, and the design, selection, and arrangement thereof, are owned by Relaxito, its licensors, or other providers of such material and are protected by international copyright and trademark laws. You are not allowed to copy, modify, distribute, sell, lease, broadcast, publicly perform, or create derivative works of our Services or their content, nor are you permitted to attempt to extract the source code of the App or our site, translate the App or our site into other languages, or reverse engineer any aspect of our Services, except to the extent permitted by applicable law.
We are constantly working to improve our Services and may update, modify, suspend, or discontinue any aspect of them at any time, with or without notice. We may also introduce new features or impose limitations on certain features or restrict access to parts or all of our Services. Where feasible, we will inform you of significant changes. We may also decide to charge fees for certain Services or features in the future; we will always inform you about any such charges before you incur them.
All user preferences and data are stored locally on your device. We do not collect or store your personal data. It is your responsibility to keep your device secure and up to date. We recommend that you do not jailbreak or root your phone, which could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone's security features, and could mean that the App won't work properly or at all. While we implement measures to protect your data within the App, we cannot guarantee absolute security.
Certain functions of our Services, particularly the App, may require an active internet connection (for example, to manage subscriptions through Superwall or access external links). This connection can be Wi-Fi or provided by your mobile network provider, but Relaxito cannot take responsibility for our Services not working at full functionality if you do not have access to Wi-Fi or if you have exhausted your data allowance. Your mobile network provider may charge you for data usage while accessing or using the App; you are responsible for these charges.
Our App and site may contain links to third-party websites or services. These third-party sites have separate and independent terms of service and privacy policies. We have no responsibility or liability for the content, activities, and practices of these linked sites. We encourage you to review the terms and policies of any third-party websites or services you visit.
We are committed to ensuring that our data collection, storage, and processing procedures comply with applicable data protection laws, including the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA). If you are a user from the European Economic Area (EEA) or California, you have certain rights regarding your personal data, as outlined in our Privacy Policy.
No user account creation is required to use Relaxito. All features are accessible without registration. Subscription management is handled through Superwall and the respective app stores.
Relaxito does not allow for uploading or sharing of user-generated content within the App or on our site. All preferences and settings remain local to your device.

Relaxito reserves the right to suspend or terminate your access to all or any part of our Services at any time, with or without cause and with or without notice. Reasons for termination may include, but are not limited to, your violation of these Terms of Service or your engagement in conduct deemed harmful to our Services or other users. Upon any termination, the rights and licenses granted to you in these terms will immediately cease, and you must cease all use of our Services and delete the App from your devices. Sections concerning intellectual property, disclaimers, limitations of liability, indemnity, governing law, and contact information will survive any termination of these Terms.
Relaxito reserves the right to modify these Terms of Service at any time. We will notify you of any material changes by posting the updated terms on our site and within the App or by other reasonable means, such as email. We encourage you to review this page periodically for any changes. The date of the last modification will be listed below. Changes are effective immediately after they are posted. Your continued use of our Services after the posting of changes constitutes your acceptance of the modified terms. If you do not agree with the modified terms, you must stop using our Services.
Disclaimer of Warranties: OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. ZEN SOUNDS DOES NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT OUR SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY INFORMATION PROVIDED THROUGH OUR SERVICES.
Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Relaxito, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, OUR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF Relaxito HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. You agree to indemnify, defend, and hold harmless Relaxito, its affiliates, officers, directors, employees, agents, suppliers, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to (a) your use of or access to our Services, (b) your violation of these Terms of Service, or (c) your violation of any third-party right, including without limitation any right of privacy or intellectual property rights.
These Terms of Service and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions. You agree that the courts of Sweden shall have exclusive jurisdiction to settle any such dispute or claim, and you hereby submit to the personal jurisdiction of those courts.
